Terms of Use

Draft — review with legal counsel before launch. These terms describe how the app is intended to be offered and are provided for transparency. They have not yet been reviewed by a lawyer.

1. Who these terms are with

These Terms of Use (the "Terms") form an agreement between you and Kristmann Technologies, Inhaber (sole proprietor) Claudius Kristmann, Michael-Ludwig-Rohrer-Straße 1/1, 76437 Rastatt, Germany ("we", "our", or "us"), the provider of the Lidar Scanner mobile application (the "App"). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.

2. What the App does

Lidar Scanner is an iOS app that uses your device's LiDAR sensor and camera (via Apple's ARKit RoomPlan and Object Capture) to scan rooms and objects into 3D models, generate and edit floor plans, and export the results to formats such as USDZ, RoomPlan JSON, DXF, PDF, and SVG. All scanning and processing runs on your device.

3. Licence to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple devices that you own or control, in accordance with the Apple Media Services Terms and the standard Apple end-user licence agreement for licensed applications. You may not copy, modify, reverse-engineer, resell, or redistribute the App except as permitted by law.

4. Eligibility and device requirements

The App requires an Apple device with a LiDAR sensor (for example iPhone 12 Pro / Pro Max or newer Pro models, and iPad Pro 2020 or newer); room scanning with RoomPlan requires iOS 16 or later. You are responsible for ensuring your device meets these requirements.

5. Free features and Pro subscription

• The App is freemium: core scanning and export features are available for free, and a Pro subscription unlocks additional features such as unlimited saved scans, High-Fidelity capture, CAD exports (DXF / PDF / SVG), textured mesh reconstruction, and RoomPlan JSON export.
• Pro is offered as a recurring subscription (for example weekly or annual plans) at the prices shown in the App Store at the time of purchase.
• Billing is handled entirely by Apple through your Apple ID. Payment is charged to your Apple account at confirmation of purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription, and turn off auto-renew, in your App Store account settings (Settings → your name → Subscriptions). Deleting the App does not cancel a subscription.
• Refunds are handled by Apple in accordance with Apple's policies; we do not process payments and cannot issue refunds directly.

6. Acceptable use

You agree to use the App lawfully and not to:

• scan people or private spaces without the necessary permission or legal right to do so;
• infringe the intellectual property, privacy, or other rights of any person;
• use the App for any unlawful, harmful, or fraudulent purpose;
• attempt to circumvent technical limitations, security measures, or subscription gating; or
• interfere with or disrupt the integrity or performance of the App.

You are responsible for ensuring you have the right to scan a given space or object and to use any resulting model.

7. Your content and scans

The 3D scans, models, floor plans, and exports you create with the App ("Your Content") belong to you. We do not claim ownership of Your Content and, because the App processes scans on your device, we do not access or store them. You are solely responsible for Your Content and for backing it up (for example via iCloud or by exporting files).

8. Our intellectual property

The App itself — including its software, design, branding, and underlying technology — is owned by us or our licensors (including Apple's frameworks) and is protected by intellectual property laws. These Terms grant you no rights in our intellectual property except the limited licence in Section 3.

9. Third-party services

The App relies on Apple frameworks and services (including ARKit, RoomPlan, Object Capture, StoreKit, and optional iCloud). Your use of those services is also governed by Apple's terms and privacy policy. We are not responsible for third-party services we do not control.

10. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted or error-free, or that scans, measurements, or generated models will meet any particular standard of accuracy. Do not rely on the App as the sole source for safety-critical, structural, or legally binding measurements — verify important measurements independently. Nothing in these Terms excludes warranties or liability that cannot be excluded under applicable mandatory law.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data or scans, arising from your use of (or inability to use) the App. We remain fully liable for damages caused by intent or gross negligence, for injury to life, body, or health, and where liability is mandatory under applicable law (including the German Product Liability Act). For simple negligence we are liable only for breach of an essential contractual obligation, limited to the foreseeable, contract-typical damage.

12. Termination

You may stop using the App at any time and delete it. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

13. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

14. Changes to these Terms

We may update these Terms as the App evolves or the law changes. We will post the updated version on this page and update the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
